Terms of Service

Welcome to Websgoal. These Terms of Service (“Terms”) govern your access to and use of the Websgoal website, https://websgoal.com/, and the services provided by Websgoal, also known as Websgoal Agency.

Websgoal helps home service businesses and other organizations get found, get chosen, and grow through high-converting website design, WordPress and WooCommerce development, Local SEO, digital marketing, AI-powered solutions, workflow automation, and related digital services.

In these Terms, “Websgoal,” “Websgoal Agency,” “we,” “us,” and “our” refer to the business operating under the Websgoal brand. “You” and “your” refer to any website visitor, prospective customer, client, authorized representative, or other person accessing our website or services.

Please read these Terms carefully before using our website or engaging our services. By accessing or using our website, you agree to the provisions that apply to website use. By purchasing or engaging our services, you also agree to the applicable proposal, statement of work, service agreement, invoice terms, and any other written terms accepted by both parties.

If you do not agree with these Terms, please discontinue the relevant website use or service engagement.

Not every service is available in every location or included in every engagement. The services we will provide, along with their scope, price, delivery schedule, and other conditions, will be specified in the applicable written proposal or service agreement.

2. Eligibility and Authority

You must have the legal capacity to enter into a binding agreement under the laws applicable to you.

You agree to provide accurate and complete information when contacting us, requesting a quote, entering into an agreement, or providing information necessary for service delivery.

We reserve the right to decline an inquiry or service engagement where permitted by law, including where we cannot reasonably meet the requested requirements or where the engagement would involve unlawful, fraudulent, or prohibited activity.

3. Website Use and Acceptable Conduct

You may use our website for lawful purposes, including learning about Websgoal, reviewing our services and portfolio, requesting information, and contacting our team.

You agree not to:

  • Use our website for unlawful, fraudulent, deceptive, or harmful activities.
  • Attempt to gain unauthorized access to our website, servers, accounts, or systems.
  • Interfere with, disrupt, damage, or overload our website or its infrastructure.
  • Introduce malicious code, viruses, harmful scripts, or other destructive technologies.
  • Scrape, harvest, or collect personal information through our website without proper authorization.
  • Use automated tools to extract website content in a way that violates applicable law or our rights.
  • Copy, reproduce, distribute, or commercially exploit our website content without permission, except as allowed by law.
  • Impersonate another person or misrepresent your identity, affiliation, or authority.
  • Use our website or services to infringe intellectual property rights, violate privacy rights, or facilitate illegal activity.
  • Attempt to reverse engineer, bypass, or compromise security measures protecting our website or systems.

We may restrict or suspend access where reasonably necessary to protect our website, users, clients, or business, investigate suspected misuse, or comply with legal obligations.

4. Project Proposals, Scope, and Agreements

Before commencing a paid project, we may provide a proposal, quotation, statement of work, service agreement, or other written confirmation describing the engagement.

Depending on the project, the written agreement may specify:

  • Project objectives and deliverables.
  • Included pages, features, integrations, and functionality.
  • Design and development requirements.
  • Client responsibilities and required materials.
  • Project milestones and estimated delivery dates.
  • Fees, deposits, payment schedules, and applicable taxes.
  • Number of included revisions and the approval process.
  • Hosting, licensing, maintenance, and ongoing support arrangements.
  • Intellectual property ownership and licensing.
  • Acceptance criteria, warranties, limitations, and termination conditions.

A project begins when the applicable agreement has been accepted and any required initial payment, access, information, or other prerequisites have been provided.

Only services and deliverables expressly included in the agreed scope are included in the project price. Additional features, new requirements, significant revisions, additional pages, integrations, or other work outside the agreed scope may require a change order, revised quotation, or additional fee.

Changes to the scope, price, or schedule should be documented and approved in writing by the relevant parties.

Website browsing, a consultation, a preliminary discussion, or an informal estimate does not by itself guarantee that Websgoal will accept or undertake a project.

5. Fees, Invoices, and Payment

The fees for our services will be stated in the applicable proposal, service agreement, or invoice.

Unless otherwise agreed in writing:

  • Fees are payable according to the payment schedule specified in the applicable agreement or invoice.
  • A deposit or advance payment may be required before work begins.
  • Milestone payments may be required before subsequent phases of a project.
  • Recurring services, subscriptions, hosting, maintenance, or retainers may be billed on a recurring schedule if agreed.
  • You are responsible for applicable taxes, duties, or similar charges associated with your purchase, except for taxes imposed on our income.
  • Third-party expenses, including hosting, domains, premium plugins, themes, software subscriptions, advertising spend, stock assets, and external platform fees, are not included unless expressly stated.
  • Any change to agreed fees or payment arrangements must be communicated and accepted as required by the applicable agreement.

You agree to pay invoices by the stated due date. If you dispute an invoice, you should notify us promptly in writing and identify the disputed amount and reasons. Any undisputed amount remains payable according to the applicable agreement.

If payment is overdue, we may provide written notice and, where permitted by the applicable agreement and law, suspend work, withhold delivery, restrict access to services we operate, or pause ongoing support until the overdue amount is resolved.

Any late-payment interest, administrative charge, collection cost, or other remedy will apply only where stated in the applicable agreement and permitted by law.

We are not responsible for delays caused by an overdue payment or a failure to provide required payment authorization.

6. Cancellations, Refunds, and Project Termination

Cancellation and refund eligibility depend on the nature of the service, work already performed, third-party commitments, and the applicable written agreement and refund policy.

If you wish to cancel a project or ongoing service, you must notify us in writing using the contact details provided in these Terms or in your service agreement.

Unless otherwise agreed in writing:

  • You remain responsible for fees for work completed, milestones achieved, and services provided up to the effective cancellation date.
  • Approved third-party costs, non-cancellable commitments, and expenses incurred on your behalf may remain payable where permitted by law and the applicable agreement.
  • Any refund for prepaid, unused services will be determined under the applicable service agreement and refund policy, subject to applicable law.
  • A deposit is not automatically refundable or non-refundable solely because it is called a “deposit”; its treatment depends on the agreed terms, work performed, and applicable law.
  • Cancellation of recurring services does not automatically cancel separate third-party subscriptions or accounts that you control.

If Websgoal terminates a project without client breach, the applicable agreement should determine the treatment of unearned prepaid fees, work in progress, and deliverables.

Nothing in these Terms excludes any refund, cancellation, or other right that cannot lawfully be excluded.

For further information, please review our Refund Policy, if published and applicable to your service.

7. Client Responsibilities

Successful digital projects require timely cooperation between Websgoal and the client.

You agree to:

  • Provide accurate project requirements, business information, and instructions.
  • Supply required text, images, videos, branding, product information, service descriptions, credentials, and other materials in a timely manner.
  • Ensure that you have the legal right to provide any materials, data, or assets supplied to us.
  • Provide necessary access to websites, hosting accounts, domain registrars, CMS platforms, advertising accounts, analytics systems, CRMs, and other tools.
  • Review designs, content, functionality, and milestones within the agreed review periods.
  • Provide clear and consolidated feedback through the agreed communication channel.
  • Appoint an authorized person to approve project decisions where appropriate.
  • Maintain control of your own accounts and use appropriate security measures.
  • Obtain any customer consents, notices, permissions, licenses, or legal approvals required for your business and website.
  • Ensure that your business practices, advertising claims, customer communications, and use of personal information comply with applicable laws.
  • Pay invoices and third-party charges when due.

Delays in providing information, approvals, access, or feedback may affect the project schedule, launch date, cost, or availability of resources. Where such delays materially affect delivery, we may reasonably revise the project timeline or propose a change to the scope or schedule.

We are not responsible for errors, delays, or functionality issues caused by inaccurate information, unauthorized client modifications, missing materials, or third-party systems outside our reasonable control.

8. Website Design and Development Services

Our website design and development services may involve research, planning, wireframes, visual design, responsive layouts, content implementation, development, testing, integrations, launch assistance, and related tasks, as specified in the project agreement.

Unless expressly included in the scope, our services do not automatically include:

  • Copywriting, professional photography, video production, or content translation.
  • Domain registration, hosting, premium software licenses, or third-party subscriptions.
  • Legal advice, privacy compliance certification, or preparation of industry-specific legal documents.
  • Ongoing maintenance, content updates, security monitoring, or technical support.
  • Unlimited revisions or unlimited post-launch changes.
  • Migration of all historical content, customer records, or third-party data.
  • Guaranteed compatibility with every device, browser, plugin, theme, or external platform.
  • Accessibility certification or a guarantee of compliance with every accessibility standard.
  • Guaranteed search rankings, traffic, leads, sales, conversions, or revenue.

Any such service may be provided if expressly agreed in writing.

We will use reasonable professional care in delivering the agreed work. However, website performance and compatibility may be affected by third-party updates, hosting limitations, client changes, external scripts, browser changes, and other factors beyond our control.

9. SEO, Local SEO, Marketing, and Advertising

Websgoal may provide SEO, Local SEO, content marketing, AEO, GEO, paid advertising, social media, conversion optimization, reputation management, and related marketing services.

Search engines, advertising platforms, directories, social networks, and other third-party services independently control their algorithms, policies, approval processes, pricing, and availability.

Accordingly:

  • We do not guarantee specific search rankings, featured snippets, AI-generated search citations, map-pack placement, website traffic, leads, calls, bookings, sales, or revenue.
  • We do not control whether a search engine indexes, removes, ranks, or displays a website or page.
  • We do not guarantee approval or continued eligibility for advertising accounts, business listings, or third-party platforms.
  • Results may vary according to competition, market conditions, website history, budgets, service quality, business reputation, client responsiveness, and other factors.
  • Changes to search algorithms, advertising policies, platform features, or third-party systems may affect performance.
  • Paid advertising budgets and third-party platform charges are separate from our management fees unless expressly included in the agreement.
  • Campaign outcomes depend on factors that may be outside our control, including competition, targeting, creative performance, conversion tracking, and the client’s ability to handle inquiries.

We will describe the work to be performed in the agreed scope and report on relevant activities or results where reporting is included. Any forecasts, estimates, case studies, or performance examples are illustrative and are not a guarantee that you will achieve the same outcome.

You remain responsible for the accuracy of your business information, service claims, offers, prices, licenses, certifications, and other claims used in your marketing unless a different responsibility is expressly agreed in writing.

10. AI Solutions, Automation, and Integrations

Websgoal may develop or configure AI-assisted websites, chatbots, lead-generation workflows, appointment systems, CRM integrations, automated communications, and other AI or automation solutions.

These services may rely on third-party models, APIs, software, platforms, and external data sources.

You acknowledge that:

  • AI-generated content or outputs may be inaccurate, incomplete, outdated, inconsistent, or unsuitable for a particular purpose.
  • Automated workflows may fail or behave unexpectedly due to configuration issues, external service interruptions, changing APIs, rate limits, data quality, or other factors.
  • Third-party providers may change their features, terms, prices, usage limits, or technical requirements.
  • AI or automation does not replace appropriate human review, professional judgment, or legal, medical, financial, or other regulated advice.
  • Certain AI tools and integrations may require separate subscriptions, usage fees, API credits, or licenses.
  • The processing of personal or confidential information through AI and third-party services must comply with applicable agreements, permissions, and privacy requirements.

Unless expressly included in the agreed scope, Websgoal does not guarantee that AI systems will operate without errors, produce a particular outcome, or remain compatible with third-party services indefinitely.

You are responsible for reviewing material AI-generated outputs before publishing or relying on them, particularly where accuracy, safety, legal compliance, customer commitments, or financial decisions are involved.

Where an AI solution performs actions affecting customers or business operations, you should maintain appropriate oversight, access controls, testing, and escalation procedures.

11. Hosting, Maintenance, and Technical Support

Hosting, maintenance, security, backups, updates, monitoring, and technical support are provided only where included in an applicable agreement or service plan.

If we provide these services, the relevant agreement should describe the service scope, response expectations, backup arrangements, restoration process, maintenance windows, and any applicable service limitations.

Unless expressly agreed otherwise:

  • We do not guarantee uninterrupted or error-free website availability.
  • Third-party hosting providers, domain registrars, plugins, themes, APIs, and software vendors may experience outages or security issues.
  • Updates may occasionally affect website functionality or compatibility.
  • Backups and restoration may be subject to the specific tools, schedules, and storage arrangements used for the service.
  • Emergency recovery, major repairs, malware remediation, and work outside the agreed support scope may incur additional fees.

You should maintain access to your domain, hosting, and essential business accounts and retain appropriate copies of critical business information. Where Websgoal manages these services, account ownership and transfer arrangements will be governed by the relevant agreement.

We will not intentionally disable or withhold client-owned assets contrary to an applicable agreement or mandatory legal requirements.

12. Third-Party Platforms, Products, and Services

Our services may incorporate or depend on third-party platforms, products, software, plugins, themes, APIs, hosting providers, payment gateways, advertising platforms, analytics services, CRM systems, scheduling tools, and AI providers.

These third parties operate under their own terms, privacy policies, license conditions, pricing structures, and technical requirements.

You acknowledge that:

  • Your use of a third-party product may require you to accept its terms or create a separate account.
  • Third-party subscriptions, licenses, usage charges, and renewals may be your responsibility unless otherwise agreed.
  • We do not control third-party availability, policies, pricing, security, or future compatibility.
  • A third-party provider may discontinue, modify, restrict, or suspend a product or feature.
  • Third-party issues may affect the performance, functionality, or availability of a website or integration.

Where a third-party license or subscription is purchased through us, ownership, renewal, transfer, and cancellation arrangements will be determined by the applicable license terms and project agreement.

We are not responsible for independent acts or omissions of third-party providers except to the extent liability cannot lawfully be excluded or is expressly assumed in a written agreement.

13. Intellectual Property and Ownership

Intellectual property rights are important to both Websgoal and our clients. Ownership and licensing will be determined by the applicable project agreement and the provisions below.

13.1 Websgoal website and materials

Unless otherwise stated, the Websgoal name, logo, website design, original website copy, graphics, documentation, and other materials created by or for Websgoal and published on our website are owned by or licensed to Websgoal.

You may view our website and use its content for personal or internal business reference. You may not reproduce, republish, distribute, modify, sell, or commercially exploit our website materials without prior written permission, except as permitted by applicable law.

13.2 Client-provided materials

You retain ownership of materials you own and provide to us, including your trademarks, logos, photographs, videos, business content, and other pre-existing assets.

You grant Websgoal a limited, non-exclusive license to use, reproduce, modify, and display those materials as reasonably necessary to perform the agreed services.

You represent that you have the rights and permissions needed for us to use the materials for the agreed purpose.

13.3 Project deliverables

Ownership of custom designs, code, website content, graphics, documentation, and other project deliverables will be specified in the applicable agreement.

Unless the project agreement states otherwise, ownership of custom deliverables that are expressly assigned to you transfers only after all amounts due for the relevant project have been paid in full.

Until that point, we retain our rights in the relevant deliverables, subject to any rights or licenses expressly granted in writing.

Once ownership has transferred, the transfer applies only to the materials expressly covered by the agreement. It does not automatically include third-party software, open-source components, pre-existing Websgoal materials, tools, libraries, frameworks, reusable code, or other assets that we do not own or that are excluded from the transfer.

13.4 Pre-existing tools and reusable materials

Websgoal may use its existing knowledge, methods, frameworks, processes, code libraries, templates, components, development tools, and general techniques to provide services.

We retain ownership of pre-existing materials and reusable elements that are not expressly assigned to the client. Where such elements are incorporated into a paid deliverable, we will provide the license or usage rights specified in the applicable agreement.

13.5 Third-party and open-source materials

Third-party software, open-source components, stock assets, themes, plugins, fonts, and other licensed materials remain subject to their respective license terms. We cannot transfer rights that we do not own.

You agree to comply with any applicable third-party license terms relevant to your use of the deliverables.

13.6 Portfolio and promotional use

Unless otherwise agreed in writing, Websgoal may request permission to display completed work, project screenshots, business names, or logos in its portfolio, case studies, or marketing materials.

Where a client has confidentiality obligations or has not granted the necessary permission, we will respect those obligations and permissions. We will not disclose confidential client information in a manner prohibited by the applicable agreement or law.

13.7 Feedback and suggestions

If you voluntarily provide suggestions or feedback about Websgoal’s services, we may use that feedback to improve our services, provided doing so does not disclose your confidential information or infringe your rights.

14. Confidentiality

Each party may receive confidential information from the other during a project. Confidential information may include non-public business plans, pricing, customer data, credentials, technical documentation, marketing strategies, source code, and other information identified as confidential or reasonably understood to be confidential.

Each party agrees to use the other party’s confidential information only for the relevant business purpose and to take reasonable steps to prevent unauthorized disclosure.

Confidential information does not include information that the receiving party can demonstrate:

  • Is or becomes publicly available through no breach of an obligation.
  • Was lawfully known to the receiving party before disclosure.
  • Is received lawfully from a third party without a confidentiality restriction.
  • Is independently developed without using the confidential information.
  • Must be disclosed under applicable law or a lawful order, subject to any legally permitted notice.

Where Websgoal processes personal information on behalf of a client, additional data processing, confidentiality, and security obligations may be set out in a separate agreement.

15. Privacy and Personal Information

Your use of our website and the handling of personal information in connection with our business are also governed by our Privacy Policy.

The Privacy Policy explains the categories of personal information we may collect, how we use it, when we share it, and the rights and choices that may be available to you.

Where Websgoal processes personal information on behalf of a client, the relevant client agreement and any applicable data processing agreement will govern that processing alongside applicable privacy law.

You must not provide us with personal information that you are not authorized to share. You are responsible for ensuring that you have an appropriate legal basis and any necessary permissions to provide personal information to us for the agreed services.

Nothing in these Terms limits rights or obligations under applicable data protection law.

16. White-Label Services for Agencies

Websgoal may provide white-label website development, design, technical support, SEO, or other digital services to agencies and business partners.

Unless otherwise agreed in writing:

  • The agency engaging Websgoal is responsible for its relationship with its end clients.
  • The agency must ensure that its instructions, materials, and requests are lawful and properly authorized.
  • The agency is responsible for communicating relevant project requirements, approvals, timelines, and commitments to its end clients.
  • Websgoal’s responsibilities are limited to the services agreed with the agency.
  • The agency must not represent that Websgoal has qualifications, certifications, capabilities, or commitments that Websgoal has not authorized.
  • Confidentiality, branding, portfolio use, ownership, client communication, and non-disclosure requirements may be governed by a separate white-label agreement.

Neither party may bind the other party to obligations toward an end client unless expressly authorized in writing.

17. Testimonials, Reviews, Case Studies, and Results

Our website may feature testimonials, reviews, portfolio projects, case studies, performance statistics, or other examples of work.

These materials are provided to illustrate our experience and services. They do not guarantee that every client will achieve the same results.

Actual outcomes may depend on factors including market conditions, competition, advertising budgets, website history, client responsiveness, business operations, service quality, and other variables.

Any client-specific results should be interpreted in their proper context. We aim to present marketing claims accurately and avoid misleading representations, but no example should be understood as a promise of a particular future result unless that commitment is expressly stated in a signed agreement.

18. Disclaimers

To the maximum extent permitted by applicable law, our public website and its general informational content are provided on an “as is” and “as available” basis.

We make reasonable efforts to keep website information useful and current, but we do not warrant that all information will always be complete, accurate, current, uninterrupted, or free from errors.

Our website content is for general informational purposes and does not constitute legal, financial, tax, medical, or other regulated professional advice.

We do not guarantee that access to our website will always be available, secure, or free from harmful components. You are responsible for using appropriate security measures when accessing online services.

Any express warranties or service commitments contained in a signed proposal or agreement remain subject to their stated terms. Nothing in this section excludes a warranty or right that cannot lawfully be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Websgoal will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising out of or in connection with website use or the services, including loss of profits, revenue, business opportunities, anticipated savings, goodwill, data, or business interruption.

To the maximum extent permitted by applicable law, Websgoal will not be responsible for losses caused by third-party platforms, hosting providers, search engine changes, advertising account restrictions, unauthorized client modifications, inaccurate client materials, or circumstances beyond our reasonable control.

For paid services, any applicable financial cap on liability should be specified in the signed service agreement. If no separate cap has been agreed, liability will be determined under applicable law, subject to any lawful limitations and exclusions.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including any liability that cannot lawfully be excluded for fraud, intentional misconduct, or other non-excludable matters.

The limitations in this section apply only to the extent permitted by the law governing the relevant claim and do not override any mandatory statutory rights.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Websgoal and its personnel from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Materials or instructions you supplied that infringe another person’s rights.
  • Your unlawful use of our website or services.
  • Your breach of the applicable agreement or these Terms.
  • Your violation of third-party license terms or applicable law.
  • Your business products, services, representations, or customer practices, except to the extent the claim results from our own breach, negligence, or wrongful conduct for which we are legally responsible.

We will provide reasonable notice of an indemnifiable claim where legally permitted and allow appropriate cooperation in its defense. No party may settle a claim in a manner that imposes an admission, obligation, or liability on the other party without that party’s consent, where such consent is reasonably required.

This section does not create indemnification obligations that are prohibited by applicable law.

21. Suspension and Termination

We may suspend or terminate access to our website or services where reasonably necessary and permitted by law, including if:

  • You materially breach these Terms or the applicable agreement.
  • You fail to pay an overdue invoice after any required notice and opportunity to remedy.
  • Your use creates a material security, legal, or operational risk.
  • You request or engage in unlawful activity.
  • A third-party platform or service necessary for the engagement is discontinued or becomes unavailable.
  • We are legally required to suspend or discontinue the relevant service.

Where reasonable and appropriate, we will provide notice and an opportunity to remedy a breach before suspending or terminating services.

You may terminate a project or recurring service in accordance with the cancellation and termination provisions of your applicable agreement.

Upon termination, each party remains responsible for obligations accrued before termination. Payment obligations, confidentiality, intellectual property, liability provisions, and other terms that by their nature should survive will continue to apply to the extent necessary and permitted by law.

The treatment of project files, account access, website transfers, prepaid fees, and work in progress will be governed by the applicable agreement.

22. Force Majeure

Neither party will be responsible for a delay or failure to perform to the extent it is caused by circumstances beyond that party’s reasonable control, such as natural disasters, war, civil unrest, government action, widespread internet or power outages, major third-party service disruptions, labor disputes, or other comparable events.

The affected party will take reasonable steps to reduce the impact and resume performance when practicable.

This section does not excuse payment obligations for services already performed or other obligations that cannot lawfully be excused. If the event materially affects a project for an extended period, the parties should discuss a reasonable adjustment, suspension, or termination under the applicable agreement.

23. Dispute Resolution

If a dispute arises in connection with our website or services, the parties should first attempt to resolve it through good-faith discussions.

You may contact us using the details in Section 27 and explain the nature of the dispute and the outcome you are seeking. Where appropriate, the parties may agree to mediation or another dispute resolution process.

Nothing in this section prevents either party from seeking urgent relief from a competent court or exercising a legal right that cannot lawfully be waived.

Any mandatory consumer protection, jurisdictional, or dispute resolution rights that apply to a particular transaction remain unaffected.

24. Governing Law and Jurisdiction

These Terms and disputes arising from website use will be governed by the laws applicable under the relevant agreement and mandatory law.

For paid services, the governing law and dispute forum should be specified in the applicable proposal or service agreement. If no separate written provision applies, the parties should determine the applicable governing law and competent forum under the relevant legal rules.

Nothing in this section deprives a consumer of mandatory rights or protections that cannot lawfully be excluded, or prevents a court from exercising jurisdiction where required by applicable law.

Publication note for Websgoal: Before publishing, insert a clear default governing-law and jurisdiction clause after confirming the correct contracting legal entity and taking advice on cross-border enforceability. Websgoal’s Bangladesh and United States office addresses do not, by themselves, establish which legal entity should be named as the contracting party.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services, technology, or legal obligations.

When we update the Terms, we will revise the “Last Updated” date at the top of this page. Where required by law or an applicable agreement, we will provide notice of material changes and obtain any necessary acceptance.

Unless otherwise stated, website-use changes will apply from the date they are published. Changes to an existing paid project will be governed by the applicable agreement and any required written acceptance.

Your continued use of our website after updated website-use terms become effective indicates acceptance of those updated terms to the extent permitted by law. Continued website use does not automatically amend a separate signed service agreement.

26. General Provisions
Entire agreement

These Terms govern the relevant website use. For paid services, the applicable proposal, statement of work, service agreement, and any incorporated policies form the agreement between the parties for that engagement. Where documents conflict, the order of precedence specified in the signed agreement will apply.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.

No waiver

A failure or delay in exercising a right does not automatically waive that right. Any waiver must be interpreted in accordance with applicable law.

Assignment

You may not transfer your rights or obligations under a paid service agreement without our written consent, except where applicable law provides otherwise. Websgoal may assign or transfer an agreement as permitted by its terms and applicable law, provided that doing so does not unlawfully diminish your rights.

Independent contractor relationship

Unless expressly agreed otherwise, Websgoal provides services as an independent contractor. These Terms do not create a partnership, joint venture, employment relationship, or agency relationship between the parties.

No third-party beneficiaries

Unless expressly stated in a written agreement or required by law, these Terms do not create enforceable rights for third parties.

Electronic communications

You agree that business communications, proposals, approvals, invoices, and notices may be provided electronically where permitted by law. Electronic acceptance may be used where valid under applicable law and the relevant agreement.

Language

These Terms are written in English. If a translation is provided, the controlling version in the event of a conflict should be identified in the applicable agreement, subject to mandatory law.
